Hells Canyon Journal September 2, 1992 Page 11 Cooley Remains on Ballot Secretary of State Phil Keisling announced August 28 that the Elections Divi- sion has determined that Wes Cooley will remain on the 1992 General Election ballot as the Republican candidate for Sen- ate District 28. A recent complaint filed with the Elections Division alleged that Cooley was not a qualified candidate because he failed to be an inhabitant of the district continuously since January 1, 1992, that his residence was not a liv- able habitation and his resi- dence was not legally estab- fished. After legislative reap- portionment left Mr. Cooley outside Senate district 28, Cooley moved a trailer onto property within the district before January 1. An investigation into whether or not Cooley com- plied with constitutional pro- visions was conducted inde- pendently by the Elections Division. "In the end," Keisling said, "absent sufficient clear and convincing evidence, we must place substantial weight on Mr. Cooley's sworn affidavit that he intended for the trailer to be his residence.
